Washington Online Poker Legal Status

Current Law

Revised Code of Washington Title 9, Chapter 46 governs gambling. The Washington State Gambling Commission (WSGC) oversees regulation. Washington is notable for explicitly classifying online poker as a Class C felony under RCW 9.46.240 — one of the few states with such a severe statutory classification for internet gambling. However, enforcement against individual players has not occurred.

Legislative Outlook

Washington's severe classification of online gambling as a felony creates a uniquely hostile legal environment, even though enforcement against individual players is absent. Tribal interests dominate the gambling landscape, and the tribes have opposed igaming. The felony classification would need to be amended before any legal online poker could operate. Most analysts do not expect movement in the near term.
