The Short Answer
Virginia does not have legal, regulated online poker. However, Virginia has been one of the most aggressive gambling-expansion states in recent years: legal mobile sports betting launched in 2021, five commercial casino licenses were authorized in 2020, and two casinos are now operational. Online poker has not been part of this expansion, but the regulatory foundation exists.
Virginia players access online poker through offshore operators. The PokerSites.org review team's top picks for Virginia players in May 2026 are BetOnline Poker and Bovada Poker.

Virginia Online Poker Legal Status
Current Law
Virginia gambling law has undergone rapid expansion:
- Virginia Lottery and Sports Betting (2020) — SB 384 and HB 4 legalized mobile and retail sports betting under the Virginia Lottery Board. Launched January 2021.
- Casino Gaming Act (2020) — SB 36 authorized five commercial casinos in Bristol, Danville, Norfolk, Portsmouth, and Richmond. Each required local voter approval.
- VA Code § 18.2-325 through § 18.2-340 — Virginia gambling offenses primarily target operators and illegal gambling businesses. Individual player prosecution for online poker is not a practical enforcement priority.
No Virginia statute addresses internet poker. The regulatory framework covers sports betting and brick-and-mortar casino gaming but does not extend to online poker or online casino games.
Virginia's Expansion Track Record
Virginia's gambling expansion since 2020 has been remarkably fast for a state with no previous commercial casino history:
- January 2021: Mobile sports betting launched with major operators
- July 2023: Hard Rock Hotel & Casino Bristol opened — Virginia's first commercial casino
- January 2023: Rivers Casino Portsmouth opened
- In development: Casinos in Norfolk (Headwaters Resort & Casino) and Danville (Caesars Virginia)
- Stalled: The Richmond casino proposal was rejected by voters in November 2021 and has faced ongoing political challenges
The speed of this expansion suggests that Virginia's political environment is favorable for gambling — but online poker specifically has not been discussed in the legislature.
iGaming Outlook
Virginia's position is interesting because:
- The state has licensed operators (DraftKings, FanDuel, BetMGM, Caesars) that also hold poker licenses in other states
- The Virginia Lottery Board has demonstrated capacity to regulate mobile gambling (sports betting)
- The new commercial casinos are potential partners for online poker operations
- Virginia borders West Virginia (which has regulated online poker under PokerStars WV) and is near Pennsylvania and New Jersey
An igaming bill that bundled online poker with online casino games — similar to Michigan's model — would be the most likely path. No such bill has been introduced as of May 2026, but the infrastructure is in place.
