Nebraska Online Poker Legal Status

Current Law

Nebraska Constitution Article III, Section 24 (amended 2020) authorizes casino gambling at licensed horse racing tracks. The Nebraska Racing and Gaming Commission oversees regulation. Nebraska Revised Statute § 28-1101 through § 28-1117 cover gambling offenses. Sports betting is retail only (on-property). No statute addresses online poker.

Legislative Outlook

Nebraska's casino industry is brand new (first properties opening 2023–2025). The state is focused on developing its land-based market. Mobile sports betting has not been authorized, and igaming is far from discussion. Most analysts do not expect online poker before 2032.
