North Carolina Online Poker Legal Status
Current Law
North Carolina gambling law is found in N.C.G.S. Chapter 14, Article 37 (Lotteries, Gaming, and Bingo):
- § 14-292 — Prohibits operating a gambling house. Targets operators, not individual players.
- § 14-309 series — Regulates video gaming machines and other specific devices.
- Tribal gaming — The Eastern Band of Cherokee Indians operates two Harrah's-branded casinos under a tribal-state compact. These are the only full-service casinos in the state.
- HB 347 (2023) — Legalized mobile and retail sports betting, which launched in March 2024. The law is specific to sports wagering and does not authorize poker or casino games.
No NC statute addresses online poker. Individual players have not been targeted for enforcement.
The Sports Betting Foundation
North Carolina's mobile sports betting market launched with eight licensed operators in March 2024. The market has generated significant tax revenue and demonstrated political viability for regulated online gambling in a state with historically conservative attitudes toward gambling.
Key infrastructure now in place: the North Carolina State Lottery Commission oversees sports betting regulation, geolocation technology is deployed, and major operators (DraftKings, FanDuel, BetMGM) have NC licenses. This infrastructure could theoretically extend to iPoker.
The Cherokee Factor
The Eastern Band of Cherokee Indians is the most powerful gambling stakeholder in North Carolina. Any igaming expansion would likely require tribal consent or participation. The Tribe's compact with the state currently covers only its two Harrah's-branded properties. An online poker product could be structured similarly to Michigan's model (where tribal and commercial operators both participate).
