Georgia Online Poker Legal Status
Current Law
Georgia gambling law is governed by O.C.G.A. § 16-12-20 through § 16-12-35 (Gambling and Related Offenses):
- § 16-12-22 — Makes it a misdemeanor to engage in gambling. However, enforcement has historically targeted operators and large-scale operations rather than individual home-game players.
- § 16-12-22.1 — Georgia's "social gambling" provision. Playing in a "bona fide social relationship" where no person receives profit other than personal winnings is a defense.
- Georgia Constitution Article I, Section II, Paragraph VIII — Only the state lottery is expressly authorized. Any other form of casino gambling requires a constitutional amendment.
