Florida Online Poker Legal Status
Current Law
Florida gambling law is fragmented across state statutes, the Seminole Compact, and a 2018 constitutional amendment:
- Florida Statutes Chapter 849 — Prohibits operating a gambling house and various gambling-related offenses. The statutes target operators rather than individual players. Playing a game of skill (which poker has been argued to be) in a private setting is generally not prosecuted.
- The Seminole Compact (2021) — A 30-year agreement between the State of Florida and the Seminole Tribe of Florida granting the Tribe exclusive rights to certain gambling activities. The compact included online sports betting via a "hub-and-spoke" model, but a federal court struck down this provision. Online poker was not included.
- Amendment 3 (2018) — Florida voters approved a constitutional amendment requiring any expansion of casino gambling to be approved by statewide ballot initiative. This effectively means that regulated online poker in Florida cannot be authorized by the legislature alone — it would likely need voter approval.
No Florida statute specifically addresses online poker played by individuals on offshore sites. No Florida resident has been prosecuted for playing online poker.
The Seminole Compact Battle
The Seminole Tribe's relationship with the State of Florida is the central factor in Florida gambling politics. Key events:
- 2021: Governor DeSantis signed a 30-year gaming compact with the Seminole Tribe, including statewide mobile sports betting through the Hard Rock Bet app

Since voters banned greyhound racing in 2018 (Amendment 13), the pari-mutuels have operated under an uncertain business model — many rely heavily on their poker rooms for revenue.
The Seminole Tribe has argued that pari-mutuel poker operations violate the Tribe's compact exclusivity. This dispute is ongoing and adds another layer of complexity to Florida gambling politics.
