California Online Poker Legal Status
Current Law
California's gambling law is governed by the California Gambling Control Act (Business and Professions Code §§ 19800–19987) and the Tribal-State Gaming Compacts under the federal Indian Gaming Regulatory Act. Neither framework addresses online poker.
The state's Penal Code §§ 330–337 criminalizes the operation of certain gambling games (primarily banked games like blackjack) but does not specifically address internet poker or make it illegal for an individual to place an online bet. The Gambling Control Commission regulates cardrooms; it has not asserted jurisdiction over online play by individuals.
In practical terms: operating an unlicensed online poker site from within California would likely violate state law, but playing on an offshore site from California occupies a grey area where enforcement has never been attempted against individual players.
Legislative History
California's online poker saga is the longest-running in US gambling politics:
- 2008–2012: Early iPoker bills introduced by State Senator Rod Wright and others. Tribal opposition prevented floor votes.
- 2014–2015: The most serious push. Assembly Bill 431 and Senate Bill 1366 advanced further than any previous attempt but stalled over the "bad actor" clause — whether PokerStars (which had operated illegally pre-Black Friday) should be allowed to enter the California market.
- 2016–2017: Coalition bills attempted to unite tribes and cardrooms. Failed over revenue-sharing disputes and exclusivity demands.
- 2018–2020: Legislative activity paused during the sports-betting ballot-measure fight (Propositions 26 and 27, both failed in 2022).
- 2022–2025: Fresh bills reintroduced but gained no traction. The tribal-cardroom split remains unresolved.
- 2026: As of May 2026, no active iPoker bill has advanced past committee.
Why California Is Stuck
The core problem is a three-way conflict:
- Tribal casinos want exclusive online poker rights (no cardroom operators allowed online)
- Licensed cardrooms (Commerce, Bicycle, etc.) want equal access to offer online poker under their existing licenses
- Horse racing interests want a cut of any online gambling revenue to offset decades of declining attendance
