Robinhood Halts Michigan Sports Markets

Michigan has now pushed a second prediction market out of its sports event contracts business. Robinhood Derivatives agreed to stop offering new sports event contracts to Michigan customers by the end of September 9, and to close all outstanding positions by October 9 โ€” a court-approved arrangement announced by the Michigan Gaming Control Board.

It follows a preliminary injunction granted against Kalshi roughly a week earlier. Two of the most prominent operators in the space are now restricted in the same state inside a month, and Michigan has become the clearest test case yet for whether states can enforce their gambling laws against federally regulated exchanges.

What the agreement actually says

The wording matters. The deal "does not concede any party's legal position." Robinhood has explicitly preserved its central argument: that the Commodity Exchange Act preempts state gambling law when event contracts are traded on a CFTC-regulated designated contract market. In other words, Robinhood is pausing, not surrendering โ€” the contracts stop while the appeal plays out.

That framing tells you where this is heading. Neither side wants a hasty ruling on the merits in a state trial court. Both are positioning for a higher forum.

And that forum may be arriving. New Jersey has petitioned the US Supreme Court to resolve who regulates prediction markets, after a run of conflicting decisions in the federal circuits. Gambling regulators in more than 20 states now take the position that sports event contracts are unlicensed sports betting. The industry takes the opposite view. Somebody eventually has to decide.

The scale of what is being argued over

This is not a fringe product any more. Prediction markets recorded more than $5 billion in trading volume across the first NFL weekend of the 2026 season โ€” their two biggest days on record. Fanatics has folded event contracts into a unified sports-betting, casino and prediction-market app. Kalshi recently passed Polymarket on volume.

At the same time, the cannibalisation story is more modest than the headlines suggest. Data from Juice Reel indicates only about 4% of regulated online sportsbook handle has permanently migrated to prediction markets, and that the shift has levelled off rather than accelerated. The American Gaming Association reported NFL betting handle essentially flat at $29.5 billion.

So the picture is: a genuinely large new market, growing fast, but not yet gutting the licensed sportsbook business. What it is doing is creating a parallel, differently regulated channel for the same economic activity โ€” which is precisely what state regulators object to.

Why poker players should care

It is tempting to file this under "sports betting news" and move on. That would be a mistake, for three reasons.

The legal theory being tested applies to more than sports. The argument is not that sports contracts specifically are commodities. It is that a CFTC-regulated exchange can list contracts on real-world outcomes and that federal law displaces state gambling regulation when it does. If that argument wins, the boundary between "gambling" and "derivatives trading" becomes something states cannot police. Poker's decades-long, state-by-state legalisation grind exists precisely because that boundary has been enforced.

Enforcement bandwidth is finite. State gaming regulators are now spending significant resources litigating against prediction markets. Michigan, Nevada, New Jersey, Iowa and Utah have all been active on this front in 2026. That is attention and legal budget not being spent on expanding regulated online poker โ€” an industry that remains stuck at nine legalised states, with live real-money sites in only six: Nevada, New Jersey, Delaware, Pennsylvania, Michigan and West Virginia.

Michigan is a regulated poker state. The MGCB is one of the more assertive regulators in the country, and it is the same body overseeing Michigan's online poker market. Its willingness to move fast against well-funded national operators is a signal about how it will treat any product it considers unlicensed gaming.

The precedent worth remembering

Poker players have seen a version of this film before. The 2006 UIGEA did not make online poker illegal in most states; it made payment processing untenable, and the practical effect was to reshape the market overnight. The lesson was that the decisive regulatory action often arrives sideways โ€” through a banking rule, a preemption argument, or a definition of what counts as a "bet" โ€” rather than through a law that mentions poker at all.

A Supreme Court ruling on whether federal commodities regulation displaces state gambling law would be exactly that kind of sideways event. A win for the exchanges would open a federally supervised route to offering wagering products nationwide. A loss would entrench the state-by-state model that has kept online poker fragmented since 2011.

What this means for players

Nothing changes about where you can legally play poker today. The US poker page tracks which states have regulated online poker and which do not, and this litigation does not alter that map in the short term. Expect more friction, not less, around anything that looks like unlicensed gaming. The same regulatory energy being applied to prediction markets is being applied to sweepstakes casinos, where at least 17 states have now banned or effectively restricted the dual-currency model. Products that sit in legal grey areas are being squeezed from several directions at once.

Watch New Jersey's petition. If the Supreme Court takes the case, it will be the most consequential gambling law decision since Murphy v. NCAA struck down PASPA in 2018. That ruling created the modern US sports betting industry. This one could redraw the perimeter of state gambling authority entirely.

Where it goes next

Robinhood's Michigan positions close out on October 9. Kalshi's injunction stands. The appeals continue. And the industry keeps growing โ€” $5 billion in a weekend is not a number that regulators can treat as a curiosity.

For poker, the immediate effect is close to nil. The medium-term effect could be substantial, because the question being litigated โ€” who gets to decide what counts as gambling in America โ€” is the same question that has governed online poker's fate for twenty years.
